The study adds that, "In the early 1990s, private health insurance plans covered prescription contraceptives much less frequently than they did other prescription drugs and devices." Equal Employment Opportunity Commission found that the failure of employers to include contraceptives in prescription drug coverage constitutes sex discrimination under Title VII of the Civil Rights Act. Beyond the threat of litigation, it would seem that the federal government's 1999 decision to require contraception in the Federal Employees Health Benefits Program (FEHBP) also became a key driver in the increased coverage metrics measured and reported by the study.
