In fact, Squire said, the two numbers almost never matched. According to Squire - and according to an elections expert hired by Squire to evaluate the system - the two totals matched in only about 10 of 300 precincts they initially investigated. And, Squire added, as they began to investigate even more precincts in advance of the Feb. 19 hearing, they found further evidence that the totals did not match.

"It's a function of the lack of reliability of this technology," said attorney Percy Squire, [Carole Squire]'s husband. "The system is designed to contain checks and balances in order to determine whether the equipment is functioning properly."

"We have an issue of whether the outcome of the election could be determined with certainty," Squire said. "It's not a simple challenge on whether the machines re operating properly. It's whether the checks and balances that are built into the system are working."
