Summary


A disabled teacher who was granted a private bathroom as part of a settlement could not sue for retaliation after construction of the bathroom was delayed, the 1st U.S. Circuit Court of Appeals has found.

The plaintiff argued that, despite her earlier settlement for injunctive relief, the delay was a failure to provide acceptable accommodations, which resulted in employment discrimination under Title II of the Americans with Disabilities Act, a hostile work environment under Title VII of the ADA and retaliation.
