Change of Judge Issue Sent to Missouri Supreme Court

Summary


The Missouri Supreme Court will weigh the concept of one judge for one family against a parent's right to a change of judge in termination of parental rights cases in an appeal transferred Tuesday by the Missouri Court of Appeals, Eastern District.

I'm hopeful that the Supreme Court will agree that parents' rights should be paramount in these cases, said St. Louis attorney Michele Hammond, who represented the father in this case. Obviously, we're wanting to protect children in termination of parental rights cases, no doubt, but the trend in the court seems to be leaning more and more toward we need to protect parents from an overly zealous Division of Family Services or an overly zealous deputy juvenile officer, whatever the case may be.
