As a bill loosening rules to form unions begins its legislative journey, lobbying activity has spiked, setting up a fierce struggle on Capitol Hill. The Employee Free Choice Act, organized labor's top priority, would force companies to recognize a union when a majority of employees sign cards authorizing one. Under current law, employers can require a secret-ballot election supervised by the National Labor Relations Board. Opponents of the bill say a provision instituting binding arbitration if employers and a union can't agree to a first contract within 120 days would substantially raise employment costs. Proponents say the rule is needed to prevent companies from delaying a first contract to death.
