Summary
The National Institutes of Health (NIH) moved quickly after President Bush signed the Consolidated Appropriations Act of 2008 on Dec 26, 2007. The act made the NIH's voluntary Public Access Policy mandatory. Clearly the NIH was ready to move on the matter, so this means a busy year for the NIH and for all the institutions that support NIH research. The law notes that the NIH shall implement the public access policy in a manner consistent with copyright law. One factor that's important to realize is that while this is a victory for open access (OA), this movement is truly a victory for public access to publicly funded research.
