Burby, that Grajcer and Broughton get specific performance of their oral contract to divide the land and to purchase the easterly half of the property after it was divided, and also awarded credit for $6,000 down payment paid toward the purchase price, $14,693.46 advanced toward dividing the property and preparing a parcel map and separate breach of contract damages of $21,926.92, plus $7,000 for the Wells fraudulent conduct, according to Riedel.
