Regardless of the exact number, illegal downloading continues to be a challenge for copyright owners and universities. The entertainment industry's response to this challenge has been a mixture of carrots and sticks. One industry carrot is to encourage colleges to enter into agreements to provide legal access to online music collections. The industry's biggest stick has been the lawsuits and letters that it files against students identified as illegal downloaders. A new stick that has the potential to impact students and universities was recently added to the entertainment industry's arsenal. Buried in an otherwise routine reauthorization of the Higher Education Act is a clause that requires colleges and universities to develop and implement plans to combat illegal downloading or risk losing access to federal financial aid money.
